Terms and Conditions:
1. Assumption of Risk and Release of Liability
By participating in any fitness training, exercise sessions, or related activities provided by Full Scale Fitness LLC (“Company”), you acknowledge and assume the risks associated with physical activity. These risks include, but are not limited to:
- The use of equipment (mechanical or otherwise) that may malfunction or break.
- The possibility of physical injury, illness, or medical complications resulting from exercise.
- The risk of slipping, tripping, or falling at any training location.
- Any injuries arising from negligence of the Company, its trainers, employees, or representatives.
Retroactive Release
By agreeing to these terms, you also acknowledge that this release applies retroactively to all past training sessions, activities, or services provided by the Company. You release and discharge Full Scale Fitness LLC from any claims related to previous training sessions, whether arising from negligence or otherwise.
2. Medical Consultation and Health Certification
- Clients are strongly encouraged to consult with a physician before beginning any fitness program.
- By agreeing to these terms, you certify that you have disclosed any known health conditions, injuries, or illnesses to the Company before engaging in training sessions.
- You understand that trainers are not licensed medical professionals, physical therapists, or healthcare providers. Any insights or recommendations provided are based solely on fitness expertise and should not be considered medical advice.
- Participation in training is at your own risk and discretion, and the Company is not liable for medical complications arising from exercise.
3. Session Policies and Procedures
Cancellations & No-Show Policy
- Clients must cancel or reschedule sessions at least 24 hours in advance to avoid forfeiting the session or incurring a cancellation fee.
- Sessions canceled within less than 24 hours of the scheduled time may be subject to full charge or deduction from prepaid packages.
Session Expiration
- Purchased training sessions must be used within the specified period outlined in your agreement with the Company.
- Unused sessions may be forfeited after the expiration date unless otherwise stated.
Session Confirmation
- Clients must confirm the completion of a session via the Company’s mobile app or another designated method.
4. Photo & Video Release
By agreeing to these terms, you grant Full Scale Fitness LLC permission to:
- Capture and use photos or videos taken during training sessions for promotional, marketing, and educational purposes.
- Publish images or videos on the Company’s website, social media platforms, and marketing materials.
- If you do not consent to photo or video use, you must notify the Company in writing before participating in any activities.
5. Digital Information Usage and Protection
Information Collection and Usage
The Company collects and uses your information, including:
- Personal details (name, email, phone number).
- Health and fitness information provided voluntarily.
- App and website usage data.
This information is used to:
- Provide customized training programs.
- Improve user experience and app functionality.
- Communicate session updates and promotional offers.
Data Security & Liability
- The Company follows industry-standard security practices to protect user data, including encryption and regular security audits.
- However, no system is completely immune to unauthorized access or hacking. You acknowledge that the Company is not responsible for any unauthorized breaches beyond its reasonable control.
- If a data breach occurs, affected clients will be notified promptly.
6. Legal Guardianship
- If signing on behalf of a minor (under 18) or an individual under legal guardianship, you confirm that you have the legal authority to do so.
- You assume all risks and responsibilities outlined in this Agreement for the individual you represent.
- The Company strongly encourages consultation with a physician for any concerns regarding the individual’s ability to safely participate in training.
7. Pricing Policy
- Full Scale Fitness LLC may adjust pricing based on individual needs, including additional resources or risks involved in training.
- Pricing adjustments comply with applicable laws and are implemented to ensure safe and effective training for all clients.
- Adjustments are not intended to discriminate but reflect the operational requirements of delivering specialized services.
8. Employer Liability Disclaimer
If your employer has engaged Full Scale Fitness LLC to provide training services:
- You acknowledge that the Company is providing services on behalf of the employer and cannot be held liable if you choose to take legal action against your employer for any reason.
- Any claims related to employer-owned equipment, facilities, or training conditions must be directed solely to the employer.
- The Company’s liability is strictly limited to the terms outlined in this Agreement.
9. Agreement & Acknowledgment
By checking the box agreeing to these Terms and Conditions, you confirm that:
- You have read, understood, and voluntarily agreed to this Agreement.
- You understand that checking the box digitally constitutes a legally binding signature.
- You release Full Scale Fitness LLC from liability and assume full responsibility for your participation.

Personal Training Policies and Procedures
Session Refunds and Packages
- All personal training sessions are non-refundable.
- Personal training packages are sold in a minimum of four (4) sessions per package.
- Session Expiration Policy:
- If a client trains once per week, all sessions must be completed within four (4) weeks of the initial session start date.
- If a client trains twice or more per week, all sessions must be completed within three (3) weeks of the initial session start date.
Payment and Scheduling
- Clients must purchase session packages prior to training.
- Payments are expected after the final session in a package has been completed.
- Example: If a client purchases 4 sessions, they must make a payment for the next package at the time of the 4th session to continue scheduling.
- Package sessions remaining after the expiration timeframe will be forfeited without refund or use.
Cancellations and Rescheduling
- If a one (1) session per week client cancels a session with more than 12 hours’ notice, the session must be rescheduled within the 4-week timeframe or it will be forfeited.
- Clients must provide at least 12 hours’ notice to cancel a session.
- Less than 12 hours’ notice or a no-show will result in the session being deducted from the package.
- How to Cancel a Session:
- Cancellations must be made through the Full Scale Fitness LLC mobile application. The app will determine whether the session is forfeited or available for rescheduling.
- If the client does not have access to the app, cancellations must be sent via:

✅ Phone Call
✅ Voicemail
✅ Email: info@fullscalefit.com - The timestamp of the message (not when the trainer responds) determines if the 12-hour notice is met.
Session Length
- Personal training sessions are up to 60 minutes in length.
Required Documentation
- Clients must complete and sign the following before their first session:
✅ PAR-Q (Physical Activity Readiness Questionnaire)
✅ Full Scale Fitness LLC Questionnaire
✅ Full Scale Fitness LLC Health Assessment
✅ Physician Approval (if applicable)
✅ Personal Training Agreement
- Clients must complete and sign the following before their first session:
Training Environment
- Clients must provide a safe and clean workout space.
- If the environment presents a risk (e.g., animals, clutter, unsanitary conditions, unsafe surroundings), the trainer may cancel the session without refund.
Property Entry & Client Responsibility
- Clients must provide written consent if they want the trainer to enter the property without knocking or announcing their arrival.
- If no written consent is given:
- The trainer must wait for the client to open the door, and any lost time from the session will not be made up.
Trainer Delays
- Trainers may experience delays due to traffic, weather, or unforeseen circumstances.
- Trainers are allowed a 5-minute grace period beyond the scheduled start time without extending the session.
- If the delay exceeds 5 minutes, the trainer will make reasonable efforts to:
- Provide the full session duration OR
- Communicate with the client to adjust the session accordingly.
App Purchases & Session Selection Responsibility
- If a client purchases sessions through the Full Scale Fitness LLC mobile application, they are responsible for selecting the correct number of sessions.
- If a client makes an error in session selection and ends up paying a higher per-session cost, Full Scale Fitness LLC is not responsible for the difference and no refunds will be issued.
Agreement & Acknowledgment
- By continuing to use Full Scale Fitness LLC’s services, the client acknowledges and agrees to these policies.
- The Assumption of Risk, Waiver of Liability, and Personal Training Policies and Procedures are intended to be as broad and inclusive as permitted by law.
- If any portion of these terms is deemed invalid, the remaining policies will continue to be in full effect.
Virtual Online Personal Training Policies
Online Personal Training Policies
1. Session Conduct
- Online training sessions will be conducted via the agreed-upon platform (e.g., Zoom, Skype).
- Clients must ensure they have:
✅ A stable internet connection
✅ A suitable workout space
2. Technical Issues
- Full Scale Fitness LLC is not responsible for technical difficulties during online sessions.
- If technical issues prevent the session from occurring, it will be rescheduled at no additional cost.
3. Privacy and Recording
- Online sessions may not be recorded or shared without written consent from both parties.
Corporate Wellness Agreements
Corporate Wellness Programs
1. Program Customization
- Corporate wellness programs are tailored based on the specific needs and goals of the organization.
- A detailed proposal and signed agreement must be in place before program initiation.
2. Participation
- Participation in corporate wellness programs is voluntary.
- Employees must sign a waiver of liability before engaging in any wellness activities.
3. Confidentiality
- Any personal information collected will remain confidential and used only for program-related purposes.
Nutrition Agreements
Nutrition Services
1. Disclaimer
- Nutrition guidance from Full Scale Fitness LLC is not a substitute for medical advice.
- Clients should consult a physician or registered dietitian for any health concerns.
2. Custom Plans
- Custom nutrition plans are based on the individual needs and goals of the client.
- Clients must provide accurate and complete information to ensure effectiveness.
3. Follow-Up and Adjustments
- Follow-ups and adjustments to nutrition plans will be provided according to the agreed-upon schedule.
Privacy Policy
1. Data Collection
- Full Scale Fitness LLC collects necessary personal information, including:

✅ Payment details (for billing purposes)
2. Data Usage
- Personal information is used only to provide services and enhance client experience.
- Full Scale Fitness LLC will not share personal data with third parties without client consent, except as required by law.

- Full Scale Fitness LLC takes appropriate security measures to protect client information.
4. Responsibility Disclaimer
- The Company is not responsible for any data leaks or breaches on our website or app, including financial or personal health data.
Modification of Terms
- Full Scale Fitness LLC reserves the right to modify these policies at any time.
- Clients will be notified of changes, and continued use of services constitutes acceptance of the modified terms.
Dispute Resolution and Governing Law
1. Dispute Resolution
- Any disputes shall first be resolved through good-faith negotiations.
- If no resolution is reached, disputes will be handled through binding arbitration under the rules of the American Arbitration Association.
2. Governing Law
- These policies are governed by the laws of the state where the services are provided.
